Terms of Use
These Terms of Use ("Terms") govern your use of the Cloudkeep: Cloud Photo Storage app and related services ("Cloudkeep", "the service"), published by Rehman Ullah ("we", "us"). By downloading or using Cloudkeep you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
1. The service
Cloudkeep lets you back up photos, videos, contacts and documents from your device to cloud storage operated for us, browse and restore them, and use an on-device storage cleaner. Features may change over time as we improve the app.
2. Eligibility and accounts
- You must be at least 13 years old (or the minimum age of digital consent in your country) to use Cloudkeep.
- You can start as a guest or sign in with Apple, Google or email. Guest data may be lost if you delete the app or change devices before signing in.
- You are responsible for activity under your account and for keeping your sign-in credentials secure. Tell us promptly about any unauthorized use.
3. Free plan and Premium subscriptions
- The free plan includes a limited backup quota. Cloudkeep Premium provides 500 GB of cloud storage and premium features, offered as weekly, monthly and yearly auto-renewing subscriptions. Current prices are shown in the app before purchase.
- Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
- Free trials, where offered, are for eligible new subscribers. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Manage or cancel your subscription in iOS Settings → your name → Subscriptions. Deleting the app does not cancel a subscription. Use Restore purchases to recover Premium on a new device.
- Purchases are processed by Apple and refunds are handled by Apple under its policies (request a refund).
- If Premium ends, your account returns to the free plan. If your stored content exceeds the free limit, you may be unable to upload more until you free up space or upgrade.
4. Your content
- You keep all rights to the photos, videos, documents and contacts you back up ("Your Content"). We do not claim ownership of it.
- You give us a limited, worldwide, non-exclusive licence to host, store, copy, transmit and display Your Content only as needed to operate the service for you (for example, to create thumbnails and deliver files back to your devices). This licence ends when you delete Your Content or your account, subject to the retention periods in the Privacy Policy.
- You confirm you have the rights needed to back up Your Content, including other people's contact details you store.
5. Acceptable use
You agree not to use Cloudkeep to store or share content that is illegal, sexually exploits children, infringes others' intellectual property or privacy, or contains malware; to attempt to access other users' data or our systems without permission; to interfere with or overload the service; or to resell or reverse engineer the service except where the law allows. We may remove content or suspend accounts that break these rules and may report illegal content to the authorities.
6. Storage cleaner and deletions
The storage cleaner suggests large files, old files and possible duplicates (files with the same size) on your device. You choose what to delete and iOS asks you to confirm every deletion. Deleted items follow iOS's normal behavior (for example, the Recently Deleted album). Before deleting anything from your device, make sure it has finished backing up. You are responsible for the deletions you confirm.
7. Availability and backups
We work to keep Cloudkeep available and your content intact, but the service is provided over the internet and may occasionally be unavailable, slow or interrupted, for example during maintenance or because of outages at our providers. Cloudkeep should not be your only copy of important or irreplaceable data — please keep additional copies.
8. Termination
You can stop using Cloudkeep and delete your account at any time in the app. We may suspend or end your access if you materially breach these Terms, if required by law, or if we discontinue the service. If we discontinue the service, we will give reasonable notice where possible so you can download Your Content.
9. Disclaimers
To the fullest extent permitted by law, Cloudkeep is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Cloudkeep. Our total liability for any claim relating to the service is limited to the amount you paid us for Cloudkeep in the 12 months before the claim, or USD 50 if you have not paid anything. Some jurisdictions do not allow these limitations, so they may not apply to you.
11. Indemnity
You agree to indemnify us against claims, losses and expenses (including reasonable legal fees) arising from Your Content or your breach of these Terms, to the extent permitted by law.
12. Apple App Store terms
You acknowledge that these Terms are between you and Rehman Ullah only, not Apple Inc. ("Apple"). The licence to use Cloudkeep is limited to a non-transferable licence to use the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions; Apple's Licensed Application End User License Agreement applies where these Terms do not address a matter. We, not Apple, are solely responsible for Cloudkeep and its content, maintenance and support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection and privacy claims, and claims that the app infringes a third party's intellectual property. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new effective date and, for significant changes, notify you in the app. Continuing to use Cloudkeep after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Disputes will be resolved by the competent courts of Pakistan, unless the consumer protection laws of your country of residence give you the right to bring proceedings there.
